Terms of Service
The short version
Emailmagic is beta software you run on your own Mac with your own accounts. It writes drafts; you decide what gets sent. The first 100 accepted testers get it free, for life; after the beta it becomes a paid subscription. It comes as it is, and we can’t promise it will be perfect.
Who we are
Emailmagic is made by Everis Holdings, 1120 S 29th Ave, Hollywood, FL 33020, United States. These terms apply to the emailmagic.app website and to the Emailmagic app. By requesting beta access or using the app, you agree to them.
The beta
Emailmagic is in beta. It will have bugs, it may change without notice, and features may be added or removed. It files email and writes drafts using AI, and AI makes mistakes. Please read every draft before you send it — you are responsible for what leaves your inbox.
Lifetime access
The first 100 accepted beta testers receive free lifetime access. That means free use of the Emailmagic app for Mac, Gmail and ChatGPT, for your own accounts, for as long as Emailmagic exists. It is personal to you and cannot be transferred or resold.
Lifetime access covers the Emailmagic app itself, including any platforms we add later — if Windows, Outlook or Claude support arrives, you get it. It does not cover separately priced add-ons, or any future product we sell under a different name.
Paying for Emailmagic
Emailmagic is free while it is in beta. After that it becomes a paid subscription. We will tell you the price and give you the choice before anything is charged; nobody gets billed by surprise.
Once paid plans start: subscriptions renew automatically for the period you chose until you cancel, and you can cancel any time from your account or by emailing us. Cancelling stops the next renewal — it does not refund the period you are already in. Prices are in US dollars and exclude sales tax or VAT, which we add where the law requires it.
Card payments are handled by Stripe. We never receive or store your card number. If a payment fails we may retry it and suspend access until it goes through. If we change the price, we will give you at least 30 days’ notice by email and you can cancel before it takes effect.
If Emailmagic is not working for you, email us within 30 days of a payment and we will refund it.
None of this applies to the first 100 beta testers — see Lifetime access above.
Your accounts
You need your own ChatGPT subscription and your own Gmail account. Those services are governed by OpenAI’s and Google’s terms, including any usage limits, and you are responsible for staying within them. Emailmagic is not affiliated with OpenAI or Google.
Acceptable use
- Don’t use Emailmagic to send spam or unsolicited bulk email.
- Don’t connect it to accounts that aren’t yours.
- Don’t use it to break the law, or the terms of Gmail or ChatGPT.
No warranty, limited liability
Emailmagic is provided as it is. We don’t guarantee it will be uninterrupted or error-free, or that every filed email or draft will be right. To the extent the law allows, we aren’t liable for indirect or consequential loss, and our total liability to you is limited to the greater of the total amount you have paid us in the twelve months before the claim (during the beta, that is nothing) or US$100. Nothing in these terms removes rights you have under consumer law that can’t be excluded.
Ending things
You can stop at any time by deleting the app, and cancel a paid subscription from your account or by emailing us. We can end the beta, or your access to it, if you break these terms. If we ever shut Emailmagic down, we will tell beta testers first and refund any unused part of a subscription.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and we agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from them.
